Returns and refunds

Right to terminate the Paulownia plant agreement.

The customer has the right to withdraw without penalty and without giving any reason after receiving the order confirmation sent by PAULOWNIA ENERGY FRANCE within a certain period of time, but at the latest within thirty (30) days from the receipt of the goods at the address indicated for delivery. The date indicated on the delivery order is fully proof of receipt.

The customer can exercise his right of withdrawal by sending an e-mail to [email protected] (please indicate the order number and the reason for the return).

If the good has already been delivered, the customer must return it to PAULOWNIA ENERGY FRANCE.

1. The return period is thirty days from the date of receipt of the goods; the date indicated on the delivery document is decisive. For the purposes of the time limit, goods are deemed to have been returned when they have been handed over to the receiving post office.
2. If the goods have been delivered, an essential condition for the exercise of the right of withdrawal is the integrity of the goods to be returned. The customer must send the goods properly packed and conditioned; PAULOWNIA ENERGY FRANCE will not accept damaged goods, but in a normal state of conservation that has been stored with ordinary care. The products damaged by detergents/additives or the products damaged by the customer due to his inexperience will not be replaced or refunded. The customer must place a copy of the delivery document received in the packaging box. The customer is entirely responsible for the risks of transporting the returned products.
3. The expenses of return of the product to PAULOWNIA ENERGY FRANCE are chargeable to the customer, if the customer exercises his right of retraction in accordance with the provisions of the present general conditions of sale, PAULOWNIA ENERGY FRANCE will refund the sums paid by the customer on the account of his credit card or Pay Pal or by using the banking co-ordinates which it will have provided. The refund will be made without expenses, within 14 days as from the day when PAULOWNIA ENERGY FRANCE will have had knowledge of the exercise by the customer of his right of retraction. In accordance with the legislative decree n° 206 of September 9, 2005 and with the article 55 of the Code of the consumption, the right of restitution envisaged in the present conditions of sale does not apply to the goods manufactured on order or clearly personalized, as well as to the goods which, because of their nature, cannot be restored or can deteriorate or be transformed quickly.

Quality guarantee for Paulownia plants and roots.

In order to avoid any inconvenience, the products are the object of punctual controls by the company before their forwarding.
However, the customer benefits from the manufacturer's guarantee, which is completed by the guarantee of PAULOWNIA ENERGY FRANCE, valid for thirty (30) days as from the delivery, within the framework of a normal use and in conformity with the recommendations stated in the documents accompanying the products and in the instructions for use. In any event, the goods sold are subject to the legal warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code.

The guarantee does not cover damage, breakdowns or malfunctions caused by failure to observe the precautions for use. In order to make use of the guarantee, the customer must return the Pavlovnia plants purchased to PAULOWNIA ENERGY FRANCE at his own expense, enclosing the original invoice. The product will be replaced by an identical product and sent to the customer at the expenses of PAULOWNIA ENERGY FRANCE, except in the event of stock shortage or of stop of the range proposed by PAULOWNIA ENERGY FRANCE. In this last case, PAULOWNIA ENERGY FRANCE will refund to the Customer the cost of the goods.

Receipt of goods in the absence of the customer.

If the recipient is absent at the time of delivery, the carrier will leave a delivery notice at the delivery address provided by the customer. If the recipient is also absent at the time of the second delivery attempt, the products will be picked up at the address and according to the terms indicated by the carrier. If the products are not picked up within the time limit set by the carrier, the products will be returned to PAULOWNIA ENERGY, which reserves the right to reimburse the cost of the products, minus the storage and return costs incurred by the customer.
